Welcome to the Motitags Toolbar (“Toolbar”) which is owned and operated by Mindspark Interactive Networks, Inc. (“Mindspark”).  Mindspark respects the privacy of users of our Toolbar, and has developed this Privacy Policy to demonstrate our commitment to protecting your privacy. These privacy policies (the "Privacy Policy") are intended to describe for you, as an individual who is a user of the Toolbar, the information we collect, how that information may be used, with whom it may be shared, and your choices about such uses and disclosures.

A.  INFORMATION WE COLLECT

We only collect Anonymous Information.  Anonymous Information means information that does not directly or indirectly identify you, such as the number of Motitags used, link clicks, and login times.   We may use the Anonymous Information to create Aggregate Information.  Aggregate Information is the grouping of Anonymous Information into groups and/or categories, which does not identify you directly or indirectly. 

 

B.  HOW WE COLLECT INFORMATION

We may use standard Internet technology, such as web beacons and other similar technologies. Web beacons are small pieces of data that are embed in images on the pages of sites.  The information we obtain in this manner enables us to count how many Motitags are used and viewed.

 

C.  HOW WE USE THE INFORMATION WE COLLECT

We may use information that we collect to:

 

·         Deliver the products and services that you have requested;

·         Provide you with customer support;

·         Perform research and analysis of use or interest in our products, services, or content;

·         Enforce our terms and conditions;

·         Manage our business; and

 

D.  WITH WHOM WE SHARE INFORMATION

We do not share information with others except as indicated below:

 

1.  We are part of the IAC family of businesses (www.iac.com). We may share information we collect with our IAC companies. Sharing information with our IAC family companies enables us to provide you with information about a variety of products and services that might interest you.

 

2.  Other Situations. We may disclose your information (i) in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency, (ii) in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; (iii) to protect and defend the rights, property or safety of our company, our users, our employees, or others; (iv) to comply with applicable law or cooperate with law enforcement; (v) to enforce our Toolbar terms and conditions or other agreements or policies; and (vi) in connection with a substantial corporate transaction, such as the sale of our business or the Toolbar, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.  In addition, we may share Aggregated Information we collect, under any of the above circumstances, with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis.

 

E.  THIRD-PARTY WEBSITES

There is search box and links in the Toolbar where you may click on to link to or access other websites that do not operate under this Privacy Policy. For example, if you type in a search in the search box, you will be taken to our search results partner’s website that we do not control. These third-party websites may independently solicit and collect information, including personal information, from you and, in some instances, provide us with information about your activities on those websites. We recommend that you consult the privacy policy of all third-party websites you visit.

 

F.  HOW WE PROTECT YOUR PERSONAL INFORMATION

The security and confidentiality of you information is very important to us, thus we take the appropriate security measures (including physical, electronic and procedural measures) to help safeguard any information collected from unauthorized access and disclosure.  Please know that, despite our best efforts, no security measures are perfect or impenetrable.

 

G.  CHILDREN′S PRIVACY

Our Toolbar is intended for general audiences over the age of 13 years old. If you are not over 13 years old, DO NOT DOWNLOAD OR USE THIS TOOLBAR

 

H.  USING OUR TOOLBAR FROM OUTSIDE THE UNITED STATES

The Toolbar is intended for United State use, thus this Privacy Policy covers collection of information on or via the Toolbar in accordance with United States laws. If you are using the Toolbar outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. By using our services, you hereby agreed to the terms of this Privacy Policy.

 

I.  NO RIGHTS OF THIRD PARTIES

This Privacy Policy does not create rights enforceable by third parties or require disclosure of any information relating to users of the Toolbar.

 

J.  CHANGES TO THIS PRIVACY POLICY

We will occasionally update this Privacy Policy to reflect changes in our practices and services. When we post changes to this Privacy Policy, we will revise the "Last Updated" date at the top of this Privacy Policy. If we make any material changes in the way we collect, use, and/or share your personal information, we will notify you by prominently posting notice of the changes on the Toolbar.
